Definitions

  • “The Client” means any person or organisation dealing with The Studio or any agent, representative, servant, employee, or subcontractor of such person or organisation.

  • “The Equipment” means all fixtures and fittings and all equipment situated in or provided by The Studio.

  • “The Studio” means the location which is Creative Kin's primary studio at The Fireworks Factory, 11 No. 1 Street, Royal Arsenal, London SE18 6HD.

  • “us” or “Creative Kin” means Creative Kin Ltd.

  • "Studio Managers" means Creative Kin staff or representatives on duty during the time the studio is booked by The Client.

  • “Building” means the building in which The Studio is situated.

Governing Agreement These Terms and Conditions govern all services provided by Creative Kin. In the event that a separate, written contract has been executed between Creative Kin and The Client for a specific project or service, the terms of that specific contract shall prevail in the case of any conflict. Where no such specific contract exists, or on matters where the specific contract is silent, these Terms and Conditions shall apply in full.

Equipment The Studio agrees to provide the equipment in good working order but makes no special guarantees as to said Equipment’s functionality or suitability for The Client’s purposes. This applies in full to all Self-Op / Uncrewed Studio Hire bookings. For crewed, full-service productions where Creative Kin personnel are operating the equipment, The Client will not be held liable for any loss or damage unless it is a direct result of The Client's own negligence or misconduct. The Client may not remove any Equipment from The Studio’s premises and all Equipment must be returned promptly at the end of the hire period and in the same condition that it was in at the start of the hire period.

Studio Premises The Client shall be responsible for all or any costs or expenses incurred by Creative Kin as a result of any damage by The Client to the fabric or contents (including furniture) of The Studio premises. No alterations, decorations or additions to The Studio are permitted (unless agreed in advance with The Studio).

Health and Safety

  1. Smoking and vaping are prohibited in the building, including The Studio.

  2. Food and drink other than water are not permitted in The Studio.

  3. Prior to commencing work, Clients should familiarise themselves with the location of the clearly-marked fire exit in the building, and the fire extinguishers provided.

Terms of Use Use of The Studio and equipment is at The Client’s own risk. The Client hereby waives rights to seek legal redress for mishaps, accidents, and/or loss while on our premises. The Client agrees to leave The Studio and building in the same condition as when they arrived. The Client is solely responsible for any legal infractions they or members of their party commit during the hire period. The Client agrees to be solely responsible for the conduct and welfare of all persons accompanying them whilst in The Studio. The Studio reserves the right to stop the session and require The Client and their party to leave immediately if dangerous or negligent practices are observed. Save in respect of anything that cannot be excluded by Statute, The Studio takes no responsibility for any loss or damages suffered by The Client, caused by, or arising from its use of The Studio or any Equipment. All equipment and valuables brought on to The Studio premises by The Client shall be at The Client’s own risk.

Use of Studio and Services You may use our studio and services only for lawful purposes and in accordance with these Terms. You may not use our studio or services in any way that violates any applicable local, national, or international law or regulation, or to transmit any unsolicited or unauthorised advertising or promotional material (spam).

Content Standards The material you create or record at our studio must not be illegal, fraudulent, deceptive, infringe on any third-party's intellectual property rights, be defamatory, obscene, offensive, or promote violence or discrimination.

Intellectual Property & Promotional Use

  1. Client Ownership: The intellectual property rights for all content created by The Client in The Studio ("The Material") belong entirely to The Client.

  2. Limited Promotional License: By using our services, The Client grants Creative Kin a limited, non-exclusive license to use excerpts of The Material for the sole purpose of promoting Creative Kin's services and showcasing our work. This promotional use is strictly limited to our official website, social media channels, and direct marketing materials.

  3. Our Professional Commitments & Client's Right to Opt-Out: We will not publish any of The Client's Material before it has been previously published by The Client. The Client may opt-out of the Limited Promotional License for any given session by providing clear written notice to Creative Kin in advance of that scheduled recording session. If no such notice is received, the Limited Promotional License will be considered active for all Material created during the session.

Booking, Rescheduling and Cancellation To secure any booking, we require the service to be paid for in full at the time of booking. All bookings and subscriptions are non-refundable.

  • For Pay-As-You-Go (PAYG) Bookings: All PAYG bookings are final. We are unable to offer rescheduling or credits for these sessions. If you are unable to make your booked time for any reason, the session and fee will be forfeited. We strongly recommend our memberships for creators who require more flexibility.

  • For Subscription Members: As a key benefit of your membership, you may reschedule your booked sessions once per month, provided you give us a minimum of 48 hours' notice. The rescheduled session must be booked for an available time within the same calendar month. For any crewed sessions, a rescheduling fee of 50% of the equivalent PAYG session price will apply to cover the hard costs of the professional crew.

Your Booking & Overruns Your session starts from the time the studio is booked. Any session that overruns will be subject to an additional charge, calculated at 1.5 times the equivalent PAYG hourly rate for the service booked, billed in 30-minute blocks. By making a booking, you authorise Creative Kin to charge any valid payment card on record for all overrun charges incurred. Creative Kin reserves the right to suspend future booking rights for any client with an outstanding overrun invoice.

Memberships Memberships are charged on a monthly subscription basis until cancelled.

  1. Minimum Term & Early Termination: All memberships are subject to a minimum initial term as stated in the offer. Should a client cancel before the end of the minimum term, they will be liable for an early termination charge equal to the total value of the remaining months of the minimum term.

  2. Deferred Start Memberships: Activating a deferred start membership by adding your payment details constitutes a binding agreement to the full minimum term. Should the client cancel after activating but before the Membership Start Date, the full early termination charge will become due immediately.

  3. Cancellation Process (After Minimum Term): To cancel a membership after the minimum term, the client must provide a minimum of 30 days' written notice via email.

Service Delivery

  1. The Studio Environment: Our studio is a professionally designed and acoustically treated recording space. In the rare event of extreme external noise beyond our control (e.g., emergency sirens), Creative Kin cannot be held responsible for any disruption.

  2. For Self-Op / Uncrewed Studio Hire: We will ensure all equipment is in full working order. The Client is solely responsible for the operation of the equipment. Creative Kin accepts no responsibility for the final quality of any recording, nor for any loss of data that occurs during the studio hire period.

  3. For Crewed & Full-Service Production: Our commitment is to deliver a technically sound, professionally recorded audio and video file. In the unlikely event of a Major Technical Failure (e.g., total data loss) caused by our personnel or equipment, our liability is limited to providing a complimentary re-recording session of the equivalent duration. For a Minor Technical Fault, we will, at our sole discretion, offer a fair and appropriate remedy.

Damage to Equipment The Client must report any damage to Studio equipment immediately. The Client will be charged the full new replacement cost for any and all damage or loss of Studio equipment that occurs during their hire period. Charges will be made to the debit/credit card The Client used to secure the hire.

Studio Terms of Use Please return all props and equipment to their original place. Dispose of your waste in the bins provided. Be respectful of other studios and people on location. Do not enter any other studio without prior consent. Bookings are filmed for security and training purposes.

Visitor & Building Access

  1. Studio Location & Arrival: Creative Kin is located at The Fireworks Factory, 11 No. 1 Street, Royal Arsenal, London SE18 6HD. All clients and guests must report to the main Woolwich Works Stage Door upon arrival to be signed in.

  2. Access & Conduct During Your Visit: For security reasons, clients and their guests will be escorted by staff at all times and must not enter any restricted areas without express permission.

  3. Shared Venue Facilities: As part of your visit, you may have discretionary access to shared venue facilities (e.g., kitchen, green room). Please note access to these shared facilities is not a guaranteed part of your booking.

Force Majeure Creative Kin will not be held liable for any failure or delay in performing its obligations where such failure or delay results from a Force Majeure event beyond our reasonable control (e.g., power failure, fire, flood, governmental action).
